Australia: CCA-treated timber
The Australian Pesticides and Veterinary Chemicals Authority (APVMA) review of CCA is still on course to introduce restrictions by mid-March next year. After this date CCA may not be used to treat timber intended for garden furniture, picnic tables, exterior seating, children’s play equipment, patio and domestic decking, and handrails. CCA may still be used for preservative treatment of timber and timber products for piling and other structural foundations, residential construction, industrial and commercial construction, rural and farm use, fencing, poles, landscaping timbers, fresh and salt water structures, signage and boat construction. The APVMA could find “ … no compelling evidence from the available data to conclude that there was likely to be an unacceptable risk to public health from exposure to arsenic from CCA-treated timber.” The restrictions are therefore precautionary but they have caused a great deal of confusion and misinformation about existing CCA-treated structures.
A number of government Health departments have issued statements intended to put the public at ease. The statements by the Health departments and by the Timber Preservers Association of Australia (TPAA) have been issued to reassure the public that CCA, properly used, poses no risk either to health or to the environment. Europe: Chromium - active substance or fixative?
On 21st June 2005 the European Commission and the Competent Authorities of the Member States agreed a guidance document to tackle the discussion whether Chromium is an active substance or only a fixative. After elaborating on the term ‘sufficiently effective’, the guidance document concludes that although chromium could possibly be sufficiently effective at high concentrations, it is may not be sufficiently effective on its own under normal conditions of use (i.e. in a product containing only Chromium in typical concentrations and with typical application rates) or when used in combination with other active substances under normal conditions of use (i.e. in typical concentrations and with typical application rates) and therefore would not have to be considered as active substance in the sense of the Directive under such conditions. However, it is up to the applicant for authorisation to demonstrate that chromium contained in a product for which authorisation is requested is not acting as an active substance under the conditions of use. As a consequence, Chromium does not have to be listed in Annex I for further use in biocidal products (in combination with other active substances) - it could be used in formulations and would then have to be treated as a substance of concern in formulated products. To address the concerns about a lack of toxicology and ecotoxicology, the guidance document states that the BPD foresees the ability to request the complete data set for ‘substances of concern’. It must be underlined that this document only serves to provide guidance to the Member States and the industry. It has been conceived as an opinion of the services involved and it is not legally binding.

Europe: BPD - Third Review Regulation
On 9 July 2005 the European Commission published the Third Review Regulation (Commission Regulation (EC) 1048/2005) concerning the Biocidal Products Directive (Biocides Directive 98/8/EC). This new regulation amends Commission Regulation (EC) 2032/2003 and contains the following changes:
  • It lays down the concept of essential use, whereby Member States may apply to the Commission for an extension of the 1 September 2006 deadline where they consider that an active substance which should be removed from the market on that date is essential for them for reasons of health, safety, protection of cultural heritage or is critical for the functioning of society, and where there are no available technically and economically feasible alternatives or substitutes that are acceptable from the standpoint of environment and health.
  • It extends the 1 September 2006 deadline for certain substances, under the condition that a complete dossier will have been submitted to the competent authorities of a Member State by 1 March 2006 at the latest. These substances are substances that were only identified and notified substances, for product types not notified.
  • It updates among others the list of notified existing active substances and the product types in which they were notified, taking into account all withdrawals and cases where no dossier was submitted.
  • It allocates Rapporteur Member States for the substances of the 3rd and 4th priority lists, which had not yet been allocated.

Sale of the Rütgers Chemicals businesses
International Chemical Investors (INCI), an equity Group based in Frankfurt, has agreed to buy five fine and specialty chemicals units of Rütgers Chemicals. The sale of the Rütgers Chemicals businesses is still subject to approval by the boards and regulatory authorities, but is expected to be completed in the coming weeks. Included in the sale is the unit Rütgers Organics that produces wood preservatives. This unit will retain its current name on both sides of the ocean.

Nominations 2006
This is a reminder to Members to nominate candidates to the Executive Council in 2006. Three new members on the Executive Council will be elected, two representing members and one representing sponsors.
The detailed procedure is described in IRG/WP 03-60180 and nominations must be made on the appropriate form to the Chairman of the Nominations Sub-Committee via the IRG Secretariat. Only valid nominations received by 31 March 2006 will be considered.
